App Terms and Conditions
Last updated: 28 September 2026
These terms govern your use of the Sip & Pay guest app at app.sipandpay.com and of the ordering pages on partner venue subdomains. By creating an account, or by placing an order without an account, you accept these terms. Data protection is covered by the Privacy Policy at sipandpay.com/privacy.
1.Who we are and what Sip & Pay is
The app is operated by Sip & Pay (Larbi Benamour, autonomo), Calle Nunez de Balboa 35A, 28001 Madrid, Spain, contact info@sipandpay.com ("Sip & Pay", "we"). Full identification details are in the Legal Notice at sipandpay.com/aviso-legal.
Sip & Pay is a technology service. It lets you browse a partner venue's menu, order, pay and split bills at your table. The venue you order at is the seller: it sets the menu and the prices, prepares and serves the products, and is responsible for them. Sip & Pay is not a party to the sale between you and the venue.
2.Your account
- You must be 18 or older to use the app. Venues that serve alcohol are adult venues and the app is not intended for minors.
- You register and sign in with your phone number and a one-time code by SMS or WhatsApp. Provide accurate details.
- Your account is personal. You are responsible for orders placed through it while your session is open.
- You can also order without an account; these terms apply equally to those orders.
- We may suspend accounts used to abuse the service, the venues or their staff, or for anything unlawful.
3.Orders and prices
- An order is placed when you confirm it and payment is authorized. From that moment the venue starts preparing it.
- All prices are shown in euros with VAT included.
- The menu, product availability and any product information are the venue's responsibility. If an item is unavailable, the venue may offer an alternative or the corresponding refund.
- For information about allergens, ask the venue's staff before ordering if the information you need is not shown in the menu.
4.Payment and receipts
- Payments are processed by Stripe. Your card details go directly to Stripe; Sip & Pay never stores card numbers. Your bank may require additional authentication.
- The payment is made to the venue. Sip & Pay does not hold your money.
- After payment you receive a receipt. Simplified invoices are issued by Sip & Pay in the name and on behalf of the venue, under a third-party billing agreement. If you need a full invoice with your tax details, request it from the venue.
5.Split bill and groups
- You can create or join a group to order together and split the bill. Each member pays their share.
- Members of a group can see the group's orders and amounts. Join a group only with people you are actually sharing a table with.
- An order is complete when the full amount has been paid. Unpaid shares remain the responsibility of the group at the table, and the venue may require settlement before serving.
6.Tips
You can add a voluntary tip when paying. Tips are passed on to the venue for its staff and are not a Sip & Pay fee.
7.Loyalty points
- Partner venues may run a points programme. Points are earned per venue, at the rate that venue sets, and are redeemable only at that venue, for the rewards that venue defines.
- Points have no cash value, cannot be transferred or exchanged for money, and are personal to your account.
- A venue may change or end its programme with reasonable notice; earned rewards you have already claimed are honoured. If you delete your account, remaining points lapse.
8.Cancellations and refunds
Orders are for food and drink prepared for immediate consumption at the venue. Once the venue has accepted your order, the legal right of withdrawal for distance contracts does not apply (article 103 of the Spanish Consumer Protection Act).
This does not limit your statutory rights. If an order is wrong, incomplete or defective, tell the venue's staff at the moment, and if it is not resolved contact us at info@sipandpay.com. If you are charged for an order the venue did not accept or deliver, you will be refunded.
9.Alcohol
The sale and supply of alcohol to persons under 18 is prohibited. The venue may ask for ID and may refuse to serve alcohol as required by law. Please drink responsibly.
10.Acceptable use
Do not misuse the app: no false orders, no attempts to break, overload or probe the systems, no interference with other guests' orders or groups, and no unlawful use. The app and its content are protected by intellectual property rights.
11.Availability and liability
We work to keep the app available during venue hours, but we do not guarantee uninterrupted operation. If the app is unavailable, you can order directly from the venue's staff.
The venue is responsible for the products, their preparation and their service. To the extent permitted by law, Sip & Pay is not liable for the products sold by the venue nor for indirect damages arising from the use of the app. Nothing in these terms excludes or limits liability that cannot be excluded by law, including your statutory consumer rights.
12.Complaints and dispute resolution
For any complaint, write to info@sipandpay.com and we will respond as soon as possible. Complaints about the products or the service at the venue can also be made to the venue, which holds official complaint forms (hojas de reclamaciones) where required.
If a dispute is not resolved, you may turn to the consumer authorities and to accredited alternative dispute resolution entities under Spanish law 7/2017. If we are ever adhered to a specific ADR entity, we will identify it here and in our replies.
13.Law, language and changes
These terms are governed by Spanish law. Disputes with consumers are heard by the courts of the consumer's domicile in Spain.
These terms exist in Spanish, English and French. For consumers in Spain, the Spanish version prevails.
We may update these terms; the date above shows the current version. Material changes will be announced in the app, and orders are governed by the version in force when they are placed.
